Hello,

I've only recently become aware of my liability to pay tax in Spain on my small property, not on any income we receive (we don't rent out) but simply for owning the property and using for holidays. Based on Spanish tax law, it is seen that I (family) receive a benefit that can be quantifiable and turned into an amount of tax owed.

I'm hoping to gather a bit of information from you good people as to: Are my findings correct? Do I owe tax on a non income generating property? It seems I have missed the deadline for making this contribution after only owning my property for 1 year and by raising my head now, will I incur penalties for accidentally missing this contribution? Out of pure curiosity, do others pay this tax religiously? I want to do the right thing for the amount it is, but I wondered if others do?

Its Non Residential Tax, and it payable on your property if you rent it out or not, there is a small fine if its not paid by end of December.

If you dont pay it , when you sell your property the money will be withheld and paid out of the sale of the property plus fines for each year.

If your from the UK its advisable to pay it now as the rate is higher for non EU country which will include the UK from next year.

best to consult a qualified gestora to do this for you every year to avoid the fines.

Tony is correct. If you own property in Spain, you have to pay tax on it, whether as resident or non-resident. If you are resident in Spain and own property in the U.K. you have to pay tax on that too!

In answer to your question about whether other holiday home owners pay this tax, I for one do. However, from speaking to other holiday home owners I suspect I might be in the minority.

Thanks everyone, appreciate your words of wisdom. It's an insignificant amount in the grand scheme of things, I only have a small apartment so not worth getting into hot water over not paying.
