Hi everyone, 

My husbands Mum died in January. Her house was sold prior to her death to pay off nursing home fees, there is some money left to be distributed between my hubby and his brother, my hubby is resident here in Spain, we both are, my question is does the inheritance need to be declared here? If so how do we go about that. Any advice appreciated.

Hi Patricia, This depends on a few things, if the person that died was over 65 years and had lived in the house for over 3 years and that house was in Andalucia then there is no inheritance tax. If they lived in another province then different rules may apply.

As the house was sold prior to her passing, the proceeds now just form part of her estate.  You will PROBABLY have to declare it BUT speak to a reputable Asesor(a) that can guide you in what declaration, if any, is required.  It may cost you 50€ or so, but I guarantee it will be money well spent

If died in UK and house in UK then no.  However check with solicitor to be sure.

Need to put on declaration of assets however if pay tax in Spain and you inherit it.

I forgot to say his mums house was in The UK.
