I had to exit last month, leaving my little  house in Almeria bwhind..after trying unsuccessfully to obtain an extension. Almeria immigration a total nightmare ....throughout all of this my frantic questions and appeals for information about residency application, were lobbied about. Phone calls to the UK consulate in London were deflected back to Spain . And vice versa..no-one really seemed to know. I am literally at my wit's end right now..and my roof started leaking furiously  a day before I left...ANYThing....

  1. Did you already have a residency application in process? Because that “stops the clock” on 90 day limit until residency application has a resolution
  2. Were you living here prior to 30/12/2020? If so you and you can show proof, you are entitled to Residencia with all the benefits of the Withdrawal Agreement.
  3. Applications for Extension of Schengen stay? Outside of absolutely critical circumstances - no, you won’t get an extension.
  4. If not resident prior to 30/12/20, you have to make application for a Visa to migrate from the country in which you are domiciled.  You cannot make an application for an NLV whilst in Spain - it must be done from UK.

OK, so if not resident here (i.e. on Padrón etc) prior to cutoff - 30/12/20, you will need to apply for a visa to migrate.  The most common one is the NLV - non lucrative visa - and this must be done from the UK.

It carries a reasonably high financial requirement because the NLV does not allow employment within Spain either contracted or casual (I believe you can still earn via internet jobs as long as income is not derived from any Spanish based company)

Looking at Dario’s reply could I apply for residencia? I’ve had a house here since 1984 and have been on the padron in Cuevas for a number of years I’ve only ever been a holiday maker probably with a maximum of 1 month at any one time 

On the basis of the above could I apply for residential?

Unless you could show by means of bills etc that you took up legal residency before 31/12/20, no.  You would have to show that you arrived in the country prior to that date and have not left, that you are residing in Spain.

The timeframe to have done it is not in your favour either - anyone seeking to legalize their situation here should have had applications in by around February / March ‘21 at the latest.  You’d have a hard time explaining why you took legal residency before 31/12 but are only applying now ..,
