squatters in Spain have ultimate rights of occupation if the house was empty when they got in. Selling a house would not get them out only taking them to court which takes a long time. if children are involved then they are even less likely to be evicted as it would render the children homeless.
in the Costa del Sol there are organised gangs going round selecting empty properties, even in gated communities, and changing the locks and then selling the keys to sometimes unsuspecting renters. During Covid with so many second homes left unoccupied they have been able to pick them out easily. many owners do not have anyone to keep an eye on the property and even if they do it is not 24hrs.
never buy a property with squatters in it.
