My Partner and I are moving to Albox this year, but the Villa will be in my name only as the owner.  Can she prove that she is also residing there without proof if ownership. Am seeing a solicitor on monday to sort the TIE out and other stuff. I was wondering if anyone else had similar issues and manged to resolve it and how.

there must be a reason that you will only be as mentioned owner ( your buissiness) BUT be careful, if you are not married and you wish your partner to have your inherit your property then you will have a problem, obviously your call , if you are not married then if the property is left to your partner and you do have a problem

if you have any children they will automatically inherit the property, if no children then your partner will have to pay 40 percent inheritance tax to the Spanish tax man

so be careful as this is fact

unless you are married that is the only way round it

a Spanish lawyer will not tell you this that also is a fact as it happened to us

also for proof of adress , she will register for the NIE and PAdron , you can also add her name onto the IBI , and bank account details should show POD also Spanish residencia and driving licence if you are staying here over 183 days a year from 0101 2021

hope this helps

She can certainly appear on Padrón at your house - different ayuntamientos have different requirements, but likely they would require you to sign a document giving permission for her to reside there.

Once she is on the Padrón, that will be all that’s required in terms of proof of residence for application for residency

Thank you all for replying, your comments are very helpful.  Although we are seeing a solicitor in the morning, it is very useful to have some information to go in with.  We are about to buy a property in Albox but before i part with any cash it is useful to get an understanding of any potential show stoppers

there are so many things that we never knew and certainly not advised by neither the estate agent or our lawyer asthe estate agent only wants to sell a property at all cost and the lawyer wants the buissiness so he can paid with out rocking the boat

our lawyer could have been much more helpful also the estate agent, the estate agent knew the house as it was rural required an AFO but said nothing and when we sold it cost us 3.5K thanks for that and if it has not got a septic tank then that is another 2k

when we sold and bought our new home we used SPC from the TV

NOW they are the real deal and are very strict and will not put a house on their books until all documents are in place

proper professionals and know the legalities inside out

THUS making it easier for the buyer to buy with confidence

hope this helps

I'd read up on the forum regarding AFO and Septic tank issues which was really useful has i made sure the property has an AFO and Septic Tank soakaway. I have also engaged Angela Morales in Mojacar and not a local Albox solicitor, all gleaned from this forum.so joining this forum has been a blessing.  Thanks to all
