Buying in Spain

Found out the hard way about buying in Spain. Be aware of estate agents who ask you to put a deposit down and tell you it’s a rolling contract.

If it’s dated it ends there . We were told it didn’t but there had to be a date but it’s still rolling.

Just lost €10000 I am embarrassed to say. Don’t know who I am more disappointed in , estate agent or seller.

I’m a great believer in karma.

normally a deposit is binding and forfeited if you withdraw from the sale however, the opposite applies if the seller withdraws they are supposed to pay double the deposit to the buyer.  the deposit is usually paid to the seller and is 10% of the sale price.   A good solicitor is necessary to ensure your rights.

Unfortunately the contract was dated but the Estate agent in front of lawyer told us not to worry as it is a rolling contract.

They had English working for them but believe Spanish owned. Sellers were English. Don’t know how either sleep at night.🤬

You should always engage a solicitor. I saw the flat I liked, gave my solicitor power of atterny and picked up the keys one month later. She had dealt with everything including opening a Spanish bank account and settling up all the direct debits etv.

Did all that. Let down by estate agent and I believe the lawyer. Estate agent kept part of the deposit apparently. This was for work and time they spent sorting. My understanding is seller pays for sale. Only work they did for me was sorting out their lies in persuading me to part with €10000. Will be taking it to Spanish ombudsman shortly.
